INTRODUCTION

FIAMMA S.P.A. with registered office in ... as data controller for the processing of personal data pursuant to EU Regulation 679/2016 applicable from 25 May 2018 - General Regulation on Data Protection (GDPR) and the applicable national legislation - Code on the Protection of Personal Data Italian Legislative Decree 196/2003 as amended by the Italian Legislative Decree 101/2018 (hereinafter GDPR and national legislation are collectively referred to as "Applicable Law") recognizes the importance of protecting personal data and considers its protection one of the main objectives of its activity.
Before communicating any personal data, FIAMMA S.p.A. invites you, as a user of the Site, to carefully read this privacy policy ("Privacy Policy"), since it contains important information on the protection of personal data and the security measures adopted to ensure confidentiality in full compliance with the Applicable Regulations. This Privacy Policy, in addition:
- is intended only for the site www.fiamma.it while it does not apply to other websites accessed via external links;
- is to be understood as Information given pursuant to the Applicable Law to those who interact with the Site;
- complies with Recommendation No. 2/2001 on minimum requirements for online data collection in the European Union, adopted on 17 May 2001 by the Article 29 Working Party.

FIAMMA S.p.A. informs that the processing of personal data will be based on the principles of lawfulness, correctness, transparency, limitation of purposes and storage, minimization of data, accuracy, integrity and confidentiality. Personal data will therefore be processed in accordance with the legal provisions of the Applicable Law and the confidentiality obligations provided for therein.

  1. DATA CONTROLLER
    According to the Applicable Law, the data controller for the processing of personal data carried out through the Site is FIAMMA S.p.A.
  • 2. PERSONAL DATA SUBJECT TO PROCESSING

“Personal Data” means any information relating to an identified or identifiable individual with particular reference to an identifier such as name, an identification number, location data, an online identifier or to one or more elements characteristic of his/her physical, physiological, mental, economic, cultural or social identity.

In particular, the Personal Data collected by the Site are as follows:

a. Navigation data

The IT systems and software procedures that enable operation of this website acquire personal data as part of their standard functioning; the transmission of such data is an inherent feature of the Internet communication protocols. This information is not collected for association with identified data subjects, but may by its nature, through processing and association with data held by third parties, permit the identification of users.

This category of data includes IP addresses or the domain names of the computers of the users connecting to the site, the URI (Uniform Resource Identifier) addresses of the required resources, the time of the request, the method used to submit the request to the server, the size of the file obtained as a reply, the numeric code of the status of the reply sent by the server (ok, error, etc.) and other parameters linked with the user’s OS and computer processing environment.

These types of data are used only to obtain anonymous statistic information about the use of the Site and to check its correct operation, to allow the correct provision of the various functions requested by the user, for security reasons and to ascertain responsibility in the event of hypothetical IT violations against the Site or third parties. Data is deleted  after X days.

b. Data provided voluntarily by the user

Through the Site, the user has the opportunity to voluntarily provide Personal Data such as name and e-mail address to contact the data controller through the form "Contact Us" or to send his/her spontaneous application. FIAMMA S.p.A. will process this data in compliance with the Applicable Law, assuming that it refers to the user or to third parties who have expressly authorised it to be provided. Therefore, the user acts as an independent data controller, assuming all the obligations and responsibilities according to the law. To that effect, the user provides on this matter the widest indemnity with respect to any dispute, claim, request for compensation for damage from processing, etc. that should reach FIAMMA S.p.A. from third parties whose Personal Data has been processed through a use of the Site made by the user in violation of the Applicable Law.

c. Cookies and similar technologies

FIAMMA S.p.A. collects Personal Data through cookies. More information on the use of cookies and similar technologies is available here.

  1. PURPOSE, LEGAL BASIS AND MANDATORY OR OPTIONAL NATURE OF THE PROCESSING

The Personal Data provided by the user will be processed by FIAMMA S.p.A. for the following purposes:

  1. to register on the site;
  2. to allow the use of services reserved for registered users accessible from the reserved area of the Site;
  3. to access the B2B portal;
  4. purposes related to the execution of a contract to which the user is a party or for the execution of pre-contractual measures taken at the request of the same (e.g.: request for contact or assistance through the Contacts form);
  5. purposes of statistical research/analysis on aggregated or anonymous data, therefore without the possibility of identifying the user, aimed at measuring the functioning of the Site, measuring traffic and evaluating functionality and interest;
  6. purposes relating to the fulfilment of a legal obligation to which FIAMMA S.p.A. is subject;
  7. purposes necessary for the establishment, exercise or defence of rights in judicial proceedings or whenever the judicial authorities exercise their functions;
  8. to send in a spontaneous application.

The legal basis for the processing of Personal Data for the purposes referred to in point a), b), c) and d) is the provision of a service or response to an explicit request from the user that does not require consent under the Applicable Law.
The purpose referred to in point e) does not involve the processing of Personal Data, while the purpose referred to in points f) and g) represents a legitimate processing of Personal Data under the Applicable Law because, once the Personal Data has been provided, the processing is necessary to comply with a legal obligation to which FIAMMA S.p.A. is subject.

The purpose referred to in point h) does not require consent under the Applicable Law, with particular reference to art. 111bis of the Code on the protection of personal data.
The provision of Personal Data for the purposes listed above is optional, but failure to provide such data may make it impossible to respond to a request made by the user or comply with a legal obligation to which FIAMMA S.p.A. is subject.

  1. RECIPIENTS
    The Personal Data provided by the user may be shared, for the purposes specified in point 3, with:

a. subjects necessary for the provision of the services offered by the Site, including, by way of example, the sending of e-mails and the analysis of the functioning of the Site, who typically act as data processors of FIAMMA S.p.A.;
b. persons authorised by FIAMMA S.p.A. to process Personal Data who are committed to confidentiality or have an adequate legal obligation of confidentiality; (e.g. employees and cooperators of FIAMMA S.p.A.); (a. and b. are collectively “Recipients”);
c. judicial authorities in the exercise of their functions where required by the Applicable Law.

5. TRANSFERS
Some of the Personal Data provided by the user may be transferred to Recipients who may be located outside the European Economic Area. FIAMMA S.p.A. guarantees that in this case the electronic and paper processing of Personal Data by the Recipients takes place in compliance with the Applicable Law. In such cases, transfers shall be based either on an adequacy decision or on the Standard Model Clauses approved by the European Commission.

6. DATA STORAGE

FIAMMA S.p.A. will process Personal Data for the time strictly necessary to achieve the purposes indicated in point 3. Without prejudice to the above, FIAMMA S.p.A. will process Personal Data up to the time allowed by the Italian law to protect its interests (Art. 2946 and 2947(1)(3) of the Italian Civil Code). Further information regarding the period for which Personal Data is stored and the criteria used to determine such period can be requested by writing to the Data Controller at the addresses below.

  1. RIGHTS OF THE DATA SUBJECT

Within the limits of the Applicable Law, the user has the right to ask FIAMMA S.p.A., at any time, for access to his/her Personal Data, for its rectification or deletion or to object to its processing, for the limitation of its processing, as well as to receive, in a structured, commonly used format that can be read by an automatic device, the personal data that concerns him/her.

In accordance with the Applicable Law, the user has the right to lodge a complaint with the competent Supervisory Authority (Italian Data Protection Authority), should he/she consider that the processing of his/her data be contrary to the regulations in force.

  1. CHANGES

This Privacy Policy has been in force since September 2018. FIAMMA S.p.A. reserves the right to change or simply update the content, in part or in full, also due to changes in the Applicable Law. FIAMMA S.p.A. will inform the user of such changes as soon as they are introduced; they will be binding as soon as they are published on the Site: FIAMMA S.p.A. therefore invites the user to visit this section regularly in order to be informed of the most recent and updated version of the Privacy Policy and so that he/she is always updated on the data collected through the Site and on the use that FIAMMA S.p.A. makes of it.

9. COOKIES
A cookie is a text element that is inserted into the hard disk of a computer.
The text is downloaded into a small file. These cookies are used to analyse traffic on the websites, to indicate when a specific website is visited and allow the website applications to send information to individual users or to allow “automatic login” to restricted areas.
